Hopkins County, KY - Terry Bruce Browning, former owner of Browning Chevrolet in Madisonville has been indicted by a Webster County Grand Jury today charging him with Theft by Deception for Failure to Make Full Disclosure. This is the latest in many indictments for Mr. Browning regarding business practices at his former automotive dealership.
iSurf spoke with the Commonwealth's Attorney Zach Greenwell of Webster County Kentucky who stated the Browning's indictment was regarding loans issued by Dixon Bank in November 2008 exceeding $157,000.
The money was to cover four vehicles, a 2008 Chevrolet Avalanche, a 2008 GMC Yukon, a 2009 Chevrolet Malibu, and a 2009 Chevrolet Traverse, at a total of $157,841. "Browning purported Dixon Bank to be the first lien holder on the vehicles," said Greenwell. "However, the vehicles were under a floor plan with Fifth Third Bank already." Greenwell explained that the floor plan is a lien by Fifth Third Bank that covered all the vehicles with Browning Chevrolet.
A civil suit was filed against Browning last week in Hopkins County by Huntington National Bank alleging he commmitted fraud and a breach of contact. It was in regards to a lien on a Chevy HHR vehicle that the used car dealership sold in March. The Columbus, Ohio-based bank has been unable to receive payments on the vehicle because the former owner's lien has yet to be paid off.
