Madisonville, KY - The estate of Julia Wooten of Earlington filed a civil law-suit in Hopkins Circuit Court this week seeking damages for pain and suffering, compensation for medical bills, potential lost wages and damages for negligent actions.
33 year old John W. Hamilton, also of Earlington, was arrested back in September and charged with murder. Police say Hamilton was operating a motor vehicle at a high rate of speed on September 6th when he struck 18 year old Julia Wooten who was attempting to cross Main Street in Earlington. Hamilton was indicted on the murder charge by a Hopkins County grand jury in October.
The estate representatives filed the suit against Hamilton, Gregory Broady of Maryland, who rented the vehicle that Hamilton was driving and against the owners of the Loch Mary Center, where Hamilton was alleged to have visited and obtained alcoholic beverages. The plaintiffs also allege two of the defendants sold the alcohol beverages illegally.
Earlington Mayor Mike Seiber, created controversy surrounding the incident by posting a $20,000 bond for Hamilton who he said was a friend. Seiber now says that he wants his money back.
In October, Hamilton was arrested and charged with shop-lifting when he stole a rifle scope from Wal-mart in Madisonville. He posted bail on that charge in the amount of $50.00. The shop-lifting charge is a violation of Hamilton's murder bond agreement. He was scheduled to appear in Hopkins Circuit Court concerning the violation but that hearing has been postponed.
The civil suit will be heard in Hopkins Circuit Court.
